These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Warwick and Quinlan (“we,” “us” or “our”), concerning your access to and use of warwickandquinlan.co.za.
You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Site, and you must discontinue use immediately.
The term Warwick and Quinlan or ‘us’ or ‘we’ refers to the website owner whose registered office is Unit 7, Parow Business Park, Jean Simonis Street Cape Town, South Africa. The term ‘you’ refers to the user or viewer of our website.

Any amendments will take effect immediately on posting of the amendments on the Site. You shall be deemed to have accepted any changed terms should you continue to use the Site. We will inform you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change.

Permitted use of the Site
The purpose of the information and materials on this Site is for general information only. This Site can only be used to inform you of our services and products. Unless otherwise indicated, the Site is our proprietary property, and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us and are protected by copyright and trademark laws. Accordingly, it is prohibited to use our text, graphics, downloads, tools and/ or reproduces any of its materials in any way. The unauthorized use of this website or any of its contents may result in a claim for damages and/or be a criminal offence.
Use of information
Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. Furthermore, it shall be your responsibility to ensure that any products, services, or information available through this website meet your specific requirements.
Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
Practices, colours and typographical errors
We make every effort to display the colours, features, specifications accurately, and details of the products available on warwickandquinlan.co.za. However, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products available on warwickandquinlan.co.za.
All products are subject to availability, and we cannot guarantee that the items will be in stock. We reserve the right to discontinue any products for any reason. Prices for all products are subject to change.
By accessing and using this Site, you acknowledge that the material mentioned above may contain inaccuracies or errors. We exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
If a mistake occurs on the website, such as incorrectly listed or inaccurately priced products, warwickandquinlan.co.za has the right to cancel and refuse any orders placed for those items. In such a case, you will be refunded fully and warwickandquinlan.co.za will not be obligated to supply you with merchandise for any incorrect charges.
Because all our products are handmade, products may vary slightly in shape, size, colour, finish compared to the images listed on the website. All products are handmade, one piece at a time. No two pieces will ever be the same due to the handmade nature of our products. Any irregularities in our product should not be considered flaws.
Copyrights
The Site as a whole, including any text, graphics, trademarks or any other intellectual property, are protected by copyright laws and are prohibited from your use.
Shipping terms
We take no responsibility for an incorrect shipment when the wrong delivery address has been provided. The same applies when a client cannot be reached during two delivery attempts.
We do not provide shipping as a company service. However, should you require assistance with this, we are happy to assist on your behalf. All shipment costs are calculated according to the delivery area and will vary according to the location and dimensional weight of the desired product. Please note that we do not take any responsibility for delivering products as we are not a shipment company and all courier/delivery services are booked as a 3rd party. It is the responsibility of the buyer to make any additional arrangements. These include elevators, staircases etc. All third party delivery services used by us to deliver your products only provide standard delivery service to the ground floor. We will not be held responsible for any damages that may occur to the item after its delivery.
All international shipments need to be re-arranged with us by contacting us via email.
It is essential to understand that every order is made per order. Therefore, no items can be out of stock because every piece is made individually for you as you place your orders. However, we have the right to remove any product we feel the need to.
Competitions
Our social media competitions, sponsorships or giveaways are in no way endorsed or sponsored by Instagram. All winners and entrants need to comply with the following terms:
- entrants and winner must be over the age of 18 years old
- entrants and winner must reside in South Africa
- entrants and winner must continue following us after the competition ends
- entrants and winner must have a legitimate instagram profile, ensued by more than 50 followers and/or a public profile where the page can be reviewed.
- all profiles ensuing less than 50 followers will be deemed illegitimate as per instagram and fake.
Our terms of use, privacy policy and shipping terms apply to all competitions and giveaways.
After placing your order, you will receive an order confirmation via email. The confirmation is our acceptance of your signed order and non-refundable deposit and forms the basis of a binding Contract of Sale between yourself (the purchaser) and Warwick and Quinlan.
The confirmation is an important document. The confirmation details the specific requirements of your order. Size, choice of fabric, choice of cushion interiors, choice of legs and feet and their colour, together with any other specific instructions you have given us to personalize your furniture any further. The exact details on the confirmation will be issued as the manufacturing document for your order to be made to those instructions. Therefore, it is important that it is carefully checked by you against the order you placed and that you advise us of any errors or omissions or any further changes you require.
Once materials (particularly fabrics) have been ordered or delivered to us we are unable to accept changes or cancellations without some cost to you. Occasionally, fabric suppliers will accept return of fabrics but they will levy restocking charge, the cost of which would need to be met by you.
A non-refundable deposit of 70% of the total order value including delivery charges and VAT is payable on placing the order. The final balance is payable before the the unit can leave our factory for delivery. Payment is accepted by most debit and credit cards or by direct transfer to our bank. American Express credit cards are not accepted. If you decide to cancel the order, we may accept your cancellation but in all cases we will retain your non-refundable deposit to cover the costs we have incurred.
To cancel the contract, you must let us know in writing to our registered office or by email to bernadette@warwickandquinlan.co.za stating the reason you wish to cancel and that you accept the retention of your non-refundable deposit to cover the costs we have incurred. This term does not affect your statutory rights.
The anticipated manufacturing date is given as a week number (please consult your diary). Time of manufacturing and delivery is not of the essence in these terms and conditions. We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any delay. Occasionally, the fabrics and special materials you have chosen may not be available with the supplier. If this should happen, we will advise you of a new manufacturing date and also give you the option to select an alternative material or to wait for your original choice to become available. Please note that Loadshedding will cause knock on delays between our suppliers and Warwick and Quinlan. This is through no fault of ours and therefore cannot be held responsible.
Once your furniture has passed quality control inspection it will be photographed for our QC records and wrapped ready for our appointed delivery company to collect and carry out the delivery to you. This can be from 5 to 15 working days ( in transit ) dependent on the area of the country you reside and the number of orders the transporter has for your area.
Delivery costs for a dedicated two-man delivery are expensive but necessary to ensure the safe transit and installation in to your home. Therefore, the delivery company will collate deliveries from ourselves and other companies to make an economical delivery load to your area so that the cost is reasonable for each customer. Please try as much as possible to accept the appointment you are offered when the transport company make contact as they may not return to your area again for some weeks. Deliveries are arranged on Monday to Friday due to the transport regulations which limit the number of hours a driver can work. Please note that this is not a service that we offer as a company, we make use of a 3rd party and the responsibility lies with our customers to manage the delivery and communications from when the unit leaves our factory. Please familiarize yourself with their Terms and Conditions.
Unless otherwise specified in writing, the price quoted for your units by Warwick and Quinlan shall be exclusive of the costs of delivering the same for which Warwick and Quinlan will invoice the Customer separately. Such charges shall include the costs of freight and insurance.
Please ensure that you check the dimensions for access including the gap between your door frames, ceiling heights, width of hallways, corridors, stairs and corners. When you placed your order, we asked you to confirm that the furniture you ordered is the correct size for your needs and that the delivery company will be able to access your property and the room of your choice.
Your furniture will be made to your size and specification. It is important that you are sure that there is adequate access to your property and that the furniture can be delivered in to the room of your choice. The delivery company will make every reasonable effort to deliver your furniture in to the room of your choice, however deliveries are strictly regulated by Health and safety regulations. Returns cannot be accepted if the delivery company cannot get the furniture in to the room of your choice.
Ownership and risk of the products will pass to you on delivery. Our furniture is hand-made and therefore any sizes given, published in our literature and on our website are approximate and not exact and small tolerances must be allowed for. All our products are designed for general domestic use. The materials (fabrics, wood, springs, foams and fillings, cushions) are all sourced from leading suppliers in the industry.
Any sale prices on The Warwick and Quinlan website cannot be used in conjunction with any other offers or discounts and do not include delivery costs.
Discount codes cannot be applied retrospectively.
Discount codes do not apply to furniture that is made of a bespoke size or color.
All offers and discount codes are at Warwick and Quinlan’s sole discretion and are subject to variation or withdrawal without notice.
When it comes to painting, in particular, colors are likely to change over time as they respond to sunlight exposure and moisture content in the air.
We always try our best to make sure that the descriptions, images and prices on our website and in our literature are accurate. Sometimes we can’t control this (for instance, computer monitors can affect colour), but if you spot something that you think is amiss, let us know and we’ll try to solve it as soon as possible.
We strongly advise that you request paint samples prior to ordering to and not rely on the computer screen for color matching.
In the unlikely event, that your furniture arrives and you are not happy with the color, we can take take it back for a re-paint but collection, re-paint and re-delivery costs will apply.
Whilst every effort has been made to ensure that colour reproduction is as accurate as possible, slight variations may occur as a result of the photographic process. We always advise customers prior to ordering to request fabric samples to check that the colour and design is suitable.
Please note that fabric quantities quoted are approximate and are based on fabric no less than 137cm wide with little or no pattern repeat. Please contact us for advice if you are in any doubt (pattern repeats and differing fabric widths all have a bearing on how much fabric you will need).
If you have decided to use your own fabric, please mark up with your name and order number and send to us.
Please note that our production lead time begins on the date that we receive your fabric and order.
If there is any ambiguity about the right side of the fabric, please either mark on the fabric you send in or send us a sample piece, which side of the fabric is to be used. Lonsdale Co cannot accept liability for inadvertently using the incorrect side. It is the responsibility of the customer to inspect and check their own fabric. Although we do our best to check for any faults in the fabric we cannot accept responsibility if the goods are made up before this comes to light.
